High Court Moves Against Constitutional Protection!

I don’t know whether to label this blog post as an “Ah Ha” moment or an “I Told You So” moment—but one thing is patently clear to me…this post definitely represents a Right Wing-Defining moment—in my opinion!

Reports are circulating that our Conservative-Dominated United States Supreme Court has taken certain action to limit protections guaranteed by The Constitution in regards to “Double Jeopardy” in certain criminal proceedings.

My question: “So what is the big surprise here?  What would anybody expect but that a “Conservative” (Right Wing) Court would do anything else but take steps to weaken a Constitutional protection? Is that supposed to be some kind of big surprise or something?

It might be up for argument as to what the intent of The Right Wing really is for America, but I have my own ideas about it and that is why I blog.

I would go so far  as to suggest that as (And if) Right Wingers consolidate more and more power over the daily lives of American Citizens, we will see a lot more attempts at “Weakening” of the provisions of The Constitution because I am of the opinion that many of them may have a secret agenda  to re-write it entirely over a period of time— to suit their own Conservative aims.

Wouldn’t surprise me in the least!

There are already reportedly a whole host of malcontents out there who have been brainwashed into believing that the government does not go by the Constitution any more and there are reported to be a whole slew of Constitutional “Experts” who seem to be Heck Bent on re-interpreting the Sacred Document to make it align more closely to some vague and ill-defined notion of what the Original Founders “Intended” when they wrote it way back when.

As I see it, there are only two possibilities of what may be happening with Conservative meddling with the language and intent of The Constitution:

(1)  They want The Constitution to parrot and validate their own vision of what life in America should be.

(2)  They mistakenly believe they can turn back the clock and read the minds of the Founders who have been at rest in their graves for all these many years since a condition that I like to refer to as “Corn-Cob-Topia” represented Life on the Continent. (Back when America was a simplistic and Agrarian Country where formal education was not a requisite for survival—a tradition which, again in my opinion, seems to be what the Extreme Right wishes to resurrect and perpetuate for all of us.)

Whatever is happening with the apparent weakening of our Constitution I can only believe that if America doesn’t wake up, it won’t be long before those who bore from within against our traditions and values from the Far Right Extremes will have transformed this nation into something totally unrecognizable.

You want to know what I really think?

I think that if we are not careful who we vote into office, the Right Wing Extremeists will eventually suppress enough votes and re-district enough precincts that the “Land of The Free” will become “The Land Of Freedom To Do Exactly As The Elite Right Wing Ruling Class Tells Us To Do.”

I think the whole thing can be simplified in the following manner:  (A) If you want to get someone to swallow your religious beliefs, you write your own version of a “Study Bible.” (B) You want to get a whole country to cowtow to your ideology, you write your own version of the Constitution and convince enough people that is how it was written to begin with.

I am an American Man, 72-years-old, and a Veteran of The U.S. Military. I have served honorably in both The United States Army (National Guard) and The United States Air Force for a total of seven years and three months active duty during what is now known as The Vietnam Era. I am a concerned citizen and refer to myself as "A Crazy Left Wing Liberal Nut Case with occasional Right Wing Conservative tendencies. I am particularly concerned and grieved about the way our beloved America seems to have become so politically divided over the past few years to the point where hardly anyone seems to be able to get along or to work together and where mutual vilification seems to be a spectator sport of some kind. I am particular fearful that we might get to the point, in our internal power struggles where we would be a One Party Nation. That, in my opinion, would be a total disaster and that is what I fear certain members of the element generally known as The "Christian" Conservative Right may have in mind.

  • Too funny, you write the above while the Supreme Court is determining the Constitutionality of Obummer Care? While the majority of the states are actually challenging the act as being unconstitutional.

    I am not a lawyer but I have read your countries Constitution literally dozens of times (that would be dozens of times more than your average American citizen, I suspect) and no where in it does it state that the Federal Government has the sweeping powers required to force an American citizen to purchase anything (including health insurance). In fact the Constitutions entire purpose is about LIMITING the powers that the Federal government has, this was done to ensure that America would never fall victim to a central government, the likes of which it fought a war to escape. The founding fathers kept it pretty simple and for most who have actually taken the time to read it their intention is very clear and doesn’t need much if any interpretation.

    Its interesting that prior to the actual Supreme Court hearing that the Obummer administration was bouncing back and forth on their definition of the penalty they were going to impose for those that did not buy into the system. One day it was a tax (they are allowed to tax citizens after all), the next day it was not a tax(they had promised that their health initiative would not increase taxes). The definition changed with the weather, depending on what they felt people wanted to hear and what they could sell to the Supreme Court.

    If you check your history you will find that most challenges to the Constitution in fact come from the Left, seeking to have the document defined to suit their wish lists. Don’t believe me? Do a little research, I have. Although I didn’t expect I will hear back from you based on your aversion to actual facts.

  • Good strong Liberal response, start a discussion and once you are presented with facts that highlight the stupidity of your argument, simply move on or make fun of the issue. Diversion, the ultimate Liberal defense.

  • There is no discussion here because I find no one who can discuss anything except their personal opinions of me. I hope you are a paying subscriber. I am. But not for much longer I am afraid.

  • My opening comment on this post made no reference whatsoever to my personal opinion of you. It simply stated some actual facts and also an observation that I (and I suspect many of your readers have made) about your aversion to “actual facts”.

    Prior to writing this comment I went through a number of your posts where I had previously commented and quoted actual facts or figures that tended to disprove your position or opinion on an issue, in virtually every case you choose to ignore the facts I presented in favor of ridicule, a childish response, or no response at all.

    The bottom line is that politics is an emotional issue for most and if you plan to put your opinions out in front of the world expect a little heat. I have always found the journey a little easier when I research the issue and use the facts for the basis of a point I am trying to make. Does this mean I am always right? Of course not! But it does mean that at least I start with a rational basis for my opinions, and once in a while I get a few converts, after all facts are facts.

    I am truly sorry if I have hurt your feelings, but as they say” if you can’s stand the heat……”

    Good luck with all of your future endeavors.

  • The absolute desperation shown in the ever-present and always totally meaningless rants of some of our most enthusiastic detractors is proof enough that what we are saying is having the desired effect and needs no further verbal support and certainly needs no defense.

    Onward, Democrats, Liberals and Progressives – - – onward and upward. Let us continue to expose the dangers posed to Democracy by Rightist indoctrination wherever it may be found.

    Let us purpose with firm determination to continue to protect and preserve our traditional American Democratic Republic no matter what the attack might be from those who would distract and deter with empty rhetoric, meaningless seemingly endless words and vain attempts to confuse, conquer and divide.

    America has chosen Liberal Democrat Government more than any other ideology and for longer periods of time and there must be a good reason. We do not need to defend Righteousness to anyone. Especially those who embrace the failed policies of the Right, The Radical Right or The Extreme Right. It is History Herself who vindicates the Democrats!

    Whenever America, for whatever the reason, falls under the spell of The Right, there is always eventual Buyer’s Remorse that brings People back to their senses and elevates the Truth and Goodness of Liberal compassion once again. It seems to be an immutable universal principle.

    Good always wins in the end.
